If you believe that your human rights have been violated, you have the right to complain about such a violation. This is important to stop an ongoing violation, prevent future violations or to get compensation.
You should complain locally first – to the Moldovan authorities and courts. International and European institutions will not accept your claim if you have not first tried to complain to the local institutions. You can only go to international and European institutions if you think that the violation of your rights have not been remedied by Moldovan institutions or, in exceptional cases, if there is no effective remedy (procedure) before the national institutions as regarding your complained violation.
Complaints to the investigative judge and to prison administration
If your complaint concerns the material conditions in prison, you should prior examine whether the so called ”compensatory mechanism” procedure is suitable for this complaint.
As well, there is a wide range of matters about which you may complain both to the investigative judge (under a different procedure for general complaints, including about the actions or decisions of prison staff) and to prison administration. Prison staff and the head of your prison are responsible for the maintenance of good conditions and order at the prison. They are supervised by an institution called the National Prison Administration. Therefore, you can generally submit all complaints about the prison staff or fellow inmates to either the head of the prison or to the National Prison Administration.

In some situations you have to submit your complaint to special institutions or under special proceedings created for dealing with a specific type of claim, such as the investigation of crimes or the complaints against the decision on disciplinary sanction.
